SECTION 1 – WHAT INFORMATION DO WE COLLECT?

When you purchase any product from our Platform, as part of the buying and selling process, we collect the information that you give us such as your name, phone number, contact list,address and email address and any information that is not otherwise publicly available ("Personal Information”). When you browse our Platform, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Personal Information collected by us includes but is not limited to:

i. name, address, phone number, age, gender, date of birth, occupation, identity proof, photographs, and e-mail address.

ii. financial information, including but not limited to, billing address, bank account details, credit/debit card details, nominee name and nominee relationship to process your payment related details, payment method data to process payments for the Services, and documents required to serve as proof for the Know Your Customer (“KYC”) validation.

iii. your username, password, and other demographic information that you provide in the process of creating an account on our Platform.

iv. demographics information or opinions, and information about subjects that may interest you provided by you if you take a survey or interact with us

v. your registration or profile information sent to us by connected services such as LinkedIn, Facebook, or Twitter, as may be authorized by you.

vi. information from your computer and browser, including your IP address, BIMAPLAN cookie information, software attributes, hardware attributes, etc., is automatically collected when you browse/use/register/sign in on BIMAPLAN.

vii. search contact book if consented by the user.

viii. Contact List: Our App may request access to your contact list to enhance its functionality. We may collect and store the names, phone numbers, email addresses, and other contact information from your contact list solely for the purpose of providing you with features like inviting friends or suggesting contacts within the App. We do not sell or share this information with third parties.

ix. Images: Our App may require access to your device's photo library or camera to allow you to upload or capture images within the App. We collect and process these images to enable features like profile picture selection or in-app image editing. We do not use or share your images for any other purpose without your explicit consent.

4) Bimaplan collects/transmits/syncs/stores Email ID to enable communication of policies, promotions etc.

5) Bimaplan collects/transmits/syncs/stores Profile Picture to enable business card personalisation.

6) Bimaplan collects/transmits/syncs/stores Date of Birth to enable age validation.

7) Bimaplan collects/transmits/syncs/stores Occupation to enable a systematic record and to help insurers gauge whether or not an individual is eligible to buy an insurance policy.

8) Bimaplan collects/transmits/syncs/stores address to enable record purpose and communication through mail.

9) Bimaplan collects/transmits/syncs/stores bank details to enable crediting performance/referral/bonus and commission.

10) Bimaplan collects/transmits/syncs/stores Nominee Name to enable Policy Generation Requirements

11) Bimaplan collects/transmits/syncs/stores Nominee Relation to enable Policy Generation Requirements

12) Bimaplan collects/transmits/syncs/stores Nominee DOB to enable Policy Generation Requirements

If any Personal Information is posted online by you that is accessible to the public, Bimaplan will not be responsible for the use or misuse of such information.

SECTION 3 – CONSENT

When you provide us with Personal Information to complete a transaction, verify your credit card, place an order, we imply that you consent to our collecting it and using it for that specific reason only. If we ask for your Personal Information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no. If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at any time, by contacting us at support@bimaplan.co. However, you agree that withdrawing your consent will not affect the lawfulness of any processing we carried out before your withdrawal, nor will it affect processing of your Personal Information carried out in reliance on other lawful grounds other than consent.

Further, you can request BIMAPLAN to delete your data by dropping a mail to support@bimaplan.co. BIMAPLAN has the right to deny this request in case of any fraud, unwanted activities, or any business or compliance requirements, which requires data retention for a period of 5 (five) years. BIMAPLAN may combine information about you that we have with information we obtain from business partners or other companies.

SECTION 4 – DISCLOSURE OF INFORMATION:

We share the Personal Information provided by you to our trusted partners who collaborated or work with BIMAPLAN under confidentiality agreements. These companies may use your Personal Information to help BIMAPLAN communicate with you about offers from BIMAPLAN and our marketing partners. However, these companies do not have any independent right to share this Personal Information.

We may share Personal Information with our other corporate entities and affiliates to help us operate our business and the website or mobile application or administer activities such as detection of identity theft, fraud and other potentially illegal acts, to facilitate joint or co-branded services that you request where such services are provided by more than one corporate entity.

We may share your Personal Information with these third parties for those limited purposes. We may disclose Personal Information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process and/or if you violate our Terms of Service.

If our Platform is acquired and/or merged with another company, your Personal Information may be transferred to the new owners so that we may continue to sell products to you:

i. We may disclose Personal Information in case of a corporate sale, sale of business, reorganization, dissolution, insolvency, or such similar events;

ii. We may disclose Personal Information to protect the rights, property, and safety of BIMAPLAN and our partners; and

iii. We may disclose Personal Information for any other purpose for which the user provided it.

SECTION 5 – PAYMENT:

We use Razorpay for processing payments. We/Razorpay do not store your card data on the servers. The data is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS) when processing payment. Your purchase transaction data is only used as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is not saved. Our payment gateway adheres to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. SECTION 6 – THIRD-PARTY SERVICES:

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the Services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their Privacy Policy so you can understand the manner in which your Personal Information will be handled by these providers. In particular, remember that service providers may be located in or have facilities that are located in a different jurisdiction than either you or us. BIMAPLAN limits access to Personal Information about you to employees who we believe reasonably need to come into contact with that Personal information to provide products or services to you or in order to do their jobs. Bimaplan adopts appropriate data collection, storage and processing practices and security measures to protect against unauthorised access, alteration, disclosure or destruction of your Personal Information and data stored on our Site or Mobile Application. However, you should be aware that no server and/or location is 100% secure and it is possible that such may be entered without permission by a computer hacker or by someone similarly engaged in unauthorised access. Bimaplan is not liable if such an act occurs.

SECTION 14 – RETENTION OF DATA:

We may store and retain your Personal Information, to the extent necessary:

i. To carry out the Services and provide content for the use of our Platform. Generally, this means, we will keep your Personal Information long as your account is active or as needed to provide our Services

ii. Retain and use the Personal Information collected as necessary to comply with our legal obligations, resolve disputes and/or for other business purposes

iii. Retain your Personal Information for 5 (five) years after you cancel/ deactivate/ unsubscribe your account with us, as our business practice; and

iv. Where we have no continuing legitimate business need to process your Personal Information, we will either delete and/or anonymize it and/or, if this is not possible then we will securely store your personal data and isolate it from any further processing until deletion is possible.
